Terms of Use

These terms govern the use of the Akuta Automações app and this website. By connecting an account to the app or using the service, the client declares having read and accepted these terms and the Privacy Policy.
1. The service
Akuta Automações (“Akuta”), operated by Marcelo Amengual Tavares (MEI), CNPJ 13.720.377/0001-67, offers professionals and businesses automated publishing of Instagram and YouTube content, performance reports and, when contracted, ad management. Each client's scope, deadlines and price are set out in the proposal or contract, which prevails over these terms in case of conflict.
2. Access and accounts
- The app is restricted to Akuta clients; there is no public sign-up.
- The client declares being authorized to connect the accounts it connects and is responsible for keeping its credentials secure.
- The client may revoke the app's access at any time. Revocation stops automated publishing.
3. Client content
- Content remains the client's property. The client grants Akuta a limited license to store it, adapt its format and publish it, solely to provide the service.
- The client is responsible for the published content, including compliance with professional rules (for example, the Brazilian Federal Council of Medicine's rules on medical advertising) and with copyright and image rights.
- Texts suggested with the help of artificial intelligence are drafts and are only published after the client approves them.
4. Third-party platforms
The service relies on YouTube, Instagram and other Google and Meta platforms. By connecting a YouTube account, the client agrees to the YouTube Terms of Service and the Google Privacy Policy. Use of Instagram is subject to the Instagram Terms of Use. Changes, limits or outages on these platforms may affect the service.
5. Prohibited uses
The app may not be used to publish illegal or misleading content, content that infringes third-party rights or platform rules, to send spam, or to attempt to access accounts without authorization.
6. Availability and results
Akuta strives to keep the service available and posts on schedule, but does not guarantee uninterrupted operation or results such as reach, followers or sales. The client should monitor its accounts and report any problem to Akuta.
7. Liability
Akuta is liable for direct damages it causes in providing the service, within the limits of the law. Akuta is not liable for outages of third-party platforms or for content approved by the client.
8. Termination
The client may stop using the service at any time by revoking access and notifying Akuta. Akuta may suspend access if these terms are breached. Upon termination, data is deleted as described in the Privacy Policy.
9. Changes
These terms may be updated. Relevant changes will be communicated to clients by email; continued use of the service afterwards means acceptance.
10. Governing law and venue
These terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Erechim, Rio Grande do Sul, Brazil, are chosen to settle any dispute, unless the law provides otherwise.
